Terms of Service and Use
Welcome to Affordable Bathrooms! Our websites are located at affordablebathrooms.net (this “Site”) is owned by Homeclub, LLC.
By using Affordable Bathrooms Software, apps and online systems, you agree to these conditions. Please read them carefully.
By accessing or using this Site, mobile application or other Affordable Bathrooms product or service on any computer, mobile phone, tablet, console or other device (collectively, “Device”), you acknowledge and agree that you have read, understand and agree to be bound by these Terms of Service and any other applicable law, whether or not you are an approved Installer for Affordable Bathrooms. Affordable Bathrooms may change these Terms of Service at any time without notice. When we make changes, we will post them here. Your continued use of the Affordable Bathrooms Systems or software shall be considered your acceptance of the revised Terms of Service. If you do not agree to these Terms of Service, please do not use this Site or any Affordable Bathrooms or Homeclub Systems or software and immediately request to be cancelled as an Installer.
ELECTRONIC COMMUNICATIONS
When you use any Affordable Bathrooms System or software or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by phone, e-mail, or through our software. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
FOR OUR INSTALLERS
By partnering with Affordable Bathrooms, you agree to offer our clients reliable, quality installation service. You will work for Affordable Bathrooms as an independent contractor. You will be hired by our clients to work on a bathroom, kitchen or flooring project. You must have your own transportation, tools, and valid driver’s license. You will be required to purchase a $1,000,000 general liability insurance policy within the first 6 months working with Affordable Bathrooms.
UNAUTHORIZED SOLICITATION OF OUR CLIENTS
When you become an approved Installer and partner with Affordable Bathrooms, you agree to be hired and receive ALL your bookings (jobs) through our approved websites and booking app. If you receive a booking directly from any of our clients or client referrals, and that booking did not come thru our approved booking website or app, then that booking is considered an unauthorized solicitation. Any unauthorized booking is defined as a booking in which Affordable Bathrooms does not receive a booking fee. Your access with Affordable Bathrooms may be terminated if you violate these terms.
ACCOUNT CONFIDENTIALITY AND ACCESS
You are solely responsible for maintaining the confidentiality of your software/app portal, all activities occurring under your PRO software/ app portal and all access to and use of the Affordable Bathrooms Systems by anyone using your Installer portal, whether or not such activities and access are actually authorized by you, including but not limited to all communications, transactions, and obligations. You agree to accept responsibility for all activities that occur under your Installer login. Affordable Bathrooms shall not be liable or responsible for any loss or damage arising from any unauthorized use, access or any other breach of security of your Installer portal, including but not limited to your Installer sign-in password and email address. You acknowledge and accept that your use of the Affordable Bathrooms System is in compliance with these Terms of Service. You further acknowledge and accept that Affordable Bathrooms shall have no obligation to investigate the authorization or source of any Installer portal activity, including scheduling activity following a proper log-in to your Installer software/app or any Affordable Bathrooms site, which is defined as a matching and current Installer sign-in and user password. You shall notify Affordable Bathrooms immediately of any unauthorized access to your Installer portal or any other unauthorized use of any Affordable Bathrooms or Homeclub Systems.
You agree that Affordable Bathrooms may, without prior notice, immediately terminate, suspend or limit access to your Installer portal based on any of the following: (a) breach or violation of these Terms of Service; (b) upon request by law enforcement; (c) unforeseeable technical or security issues or problems; (d) extended periods of inactivity; or (e) fraudulent, deceptive or illegal activity, or any other activity which Affordable Bathrooms believes is harmful to its business interests: or (f) for no reason. You agree that any termination, limitation of access and/or suspension shall be made at the sole discretion of Affordable Bathrooms, and that Affordable Bathrooms shall not be liable to you or any third party for the termination, limitation of access and/or suspension of your Installer software/app Account.
